So for me, living in Switzerland, the authorities have more or less stated that chasing pirates is too much of a hassle, ineffective and a waste of resources, and hence they've decided to not give a shit. The result is that people in Switzerland can pretty much do whatever the fuck they want with impunity (for now).
Some countries also have gaps in their laws, so downloading may be legal, while uploading is illegal. Note that this means that torrents are still illegal, as you are both an up- and downloader!
Nor is it illegal to make your own roms as long as you have the original *everyone has the right to create backups of theyr own bought goods for private purposes. Couldn't have put it better myself. If someone wants to fine me for playing my favorite PS2 games with anti-aliasing they're more than welcome to do so.
So my advice would be to find out what exactly the actual laws in your country are, as well as studying whether people have been convicted in the past, and what happened to them. As people have stated, actually publishing something on a site is far, far riskier than merely downloading something.

Sonic's first proper 3d adventure is a huge game and offers plenty of lastability because of the ability to choose a character and simply wander around. The level of puzzles is superb and you can immerse yourself as little or as much as you'd like in order to complete the game. Graphically it was gorgeously ahead of it's time and the soundtrack was absolutely spot on too.
Once completed I'd find myself drawn back into playing the game from the start again (by deleting my saves) simply because it was so much fun. Redefined the phrase 'cute platformer' by tagging on an enormous game that was simply excellent. Also not as linear as the follow-up, meaning once you'd completed the tasks there was not much more fun to be had (in Sonic 2).
